The Hong Kong Jockey Club, Racecourse Improvements – Shatin Parade Ring
A significant element of the improvement works at Shatin Racecourse was the construction of a retractable roof over the new parade ring. The steel retractable roof was constructed using a fabric membrane and aluminium cladding and was the first large-scale retractable roof structure built in Hong Kong.
The project also comprised the construction of a temporary parade ring and saddling booths, works to the existing racing centre and a new parade ring which included extensions to the viewing balconies, construction of new spectator seating areas, new saddling booths, an owner's pavilion and E&M and operations control rooms. The project was required to be completed to a tight programme without disrupting ongoing racing activities.
ASTEL was contracted to supply and install the waterproofing sheet membrane for the retractable steel roof.
Aspect Asia’s Involvement
Aspect Asia was engaged by its Client following a breakdown in the final account settlement negotiations between its Client and the Main Contractor. Aspect Asia undertook a thorough review of the issues in dispute and provided strategic advice to ASTEL on the possible options for resolving matters.
Despite numerous attempts to recommence negotiations, the Main Contractor did not recognise ASTEL’s entitlements and continued to withhold monies that were due for payment.
Accordingly, ASTEL referred the dispute to ‘Documents Only’ arbitration proceedings with Aspect Asia representing ASTEL throughout the arbitration, including preparation of the Statement of Claim, Reply to Defence and Counterclaim and all written communications between the Parties and the Arbitrator.
Aspect Asia’s Client was successful on every issue in the arbitration and received an award in its favour for the full amount claimed together with interest and costs.
